Immigrants and refugees are dealing with uncertainty right now, about whether their immigration status will change and who ICE is looking to deport. Cuban, Haitian, Nicaraguan and Venezuelan immigrants were allowed to stay in the U.S., until that program was terminated in late March. Students here in Indiana have had their visas revoked and then restored.

These decisions are up against legal challenges, so it’s a changing landscape. Through it all, there are local resources to help. We talked to nonprofits who provide services to immigrants and an immigration lawyer to compile a list of what documents to carry, what to do if ICE approaches you, how to find an immigration lawyer and how to prepare in case you’re deported.

These resources come in English, Spanish and Haitian Creole. We provided PDFs you can download and print, so you can put up these lists on a bulletin board or hand them out.

What documents should I carry?

• DO carry copies of valid documentation related to your status in the U.S., such as a green card, work permit or visa.
• DO give a family member or close friend access to your original documents.
• DON’T carry documents from another country, such as your passport.

How should I prepare in case ICE approaches me?

• Memorize the phone number of a family member or an immigration lawyer.
• Carry a red “Know your rights” card. You can download and print one. If you need a printer, the Indianapolis Public Library charges 15 cents per page.
• Watch “Know your rights” videos from Patchwork Indy in several languages.

What should I do in an interaction with law enforcement?

• DON’T open your door. ICE warrants do not give officers the power to enter a private home. They would need a federal warrant signed by a judge to enter your home.
• DON’T resist arrest.
• DO remain silent. In Indiana, by law, you must tell an officer your name (IC 34-28-5-3.5). You don’t have to share any other information.

What can I do to prepare in case I am deported?

• Create an emergency plan with your family. Here’s a blank plan (Spanish version).
• Memorize your A-number from your immigrant data summary. It is the letter “A” followed by 8-9 numbers. Give the number to your family, so they can locate where ICE is detaining you.
• Designate a permanent resident or citizen to take care of your kids. Here is a resource about appointing a legal guardian (Spanish version).
• Give a permanent resident or citizen the information for your bank account. If you own a business, make sure someone else knows how to operate it.

How do I find an immigration lawyer?

Search a database. You can find lawyers from the American Immigration Lawyers Association or National Immigration Legal Services directories.

Note: Immigration lawyers often charge flat fees instead of hourly charges.

Where can I go to get basic needs filled?

• Grassroot Projects offers care packages. They give away diapers, food and clothes. They also fund summer camps and tutoring for kids.
• Gleaners, a food bank, does not require an ID to get food. They also deliver.
• The Immigrant Welcome Center can help you learn English, find a job and connect you to resources. Find more resources on their site.

Other common questions

Should I still file taxes if I am undocumented?

The IRS made an agreement with ICE to share private tax information that will help ICE locate people who have final removal orders. So, there are risks. However, if you made income in the U.S., you are legally required to file taxes.

Can I call 911 in an emergency?

Yes. If you are talking to police, you have the right to not discuss your status. If it’s a medical emergency, hospitals are required to treat anyone, regardless of immigration status.

Should I travel out of the U.S.?

This depends on your status. It can be risky for those with visas to return to the U.S. after traveling abroad. If you do travel out of the country, know your status and have documents prepared to show customs agents when you arrive in the U.S.

What do I do if someone I care about is getting arrested?

• DON’T try to stop the arrest.
• DO write down what happened during the arrest or take a video.
• Afterward, use locator.ice.gov to find where your friend or family member is being detained.
• You can apply for the Midwest Immigration Bond Fund to post bail for someone held in ICE custody.
